In this role you can work remotely from home or from our offices in Tala, Mexico or Lima, Peru.

The Fall Creek Legal Counsel, Americas (LCA) serves as a business-oriented legal advisor to the Fall Creek global group as it conducts business in Mexico, Central and South America (the “Territory”). This position requires a high degree of independent professional judgment in problem solving, researching solutions, and decision-making, as well as strong communication skills in English and Spanish. Employees in this position should expect to travel regularly within Latin America and other international destinations.

**What you'll do at Fall Creek**:

- Lead the Fall Creek global group in all aspect of their legal affairs arising in the Territory, including commercial operations, import/export requirements, protection of intellectual property rights, the administration of royalties and other reporting requirements, labor and employment issues, and the compliance with corporate requirements, including entity formation, annual compliance, matters of public registry, matters, managing powers of attorney and other corporate matters.
- Conduct due diligence and provide legal advice for expansion of business into new territories (e.g. tax issues, business structures, intellectual property and regulatory environment, effectiveness of plant breeders’ rights, etc.) and potential new licensing partners.
- Support General Counsel and other members of the global legal function in the protection of Fall Creek’s intellectual property rights and in the administration of Fall Creek’s licensing platforms (e.g. compliance, enforcement, reporting).
- Lead Fall Creek’s local acquisitions, dispute resolution, and administrative compliance.
- Provide needed legal input to support Fall Creek’s blueberry breeding efforts in the Territory by assisting with technical paperwork, test coordination, and other tasks necessary to register and protect our plant varieties.
- Other duties as assigned by the General Counsel.

**What you bring to Fall Creek**:

- Law degree and license to practice law in applicable jurisdiction(s) within the Territory.
- Legal study and/or practice experience in the United States.
- Bilingual oral and written fluency in Spanish and English.
- 10+ years’ experience in the practice of law in a position that includes drafting of legal documents and contract negotiations.
- Extensive knowledge of business law and a strong working knowledge of intellectual property law.

**DESIRED QUALIFICATIONS**
- J.D. or L.L.M. degree; licensure in one or more U.S. states ideal but not necessary.
- Experience working in an international law firm and/or matrixed multinational company.
- Experience in developing budgets and managing expenses.
- Experience working in a high-growth start-up environment.
- Experience with, or interest in, agriculture, horticulture, or fruit.
- A high degree of emotional intelligence; a flexible and growth-oriented mindset; a sense of humor.
